1. Booking and Payment
A deposit of 50% of the total tour price is required to secure your reservation.
The remaining balance is due no later than 60 days prior to the scheduled tour departure date. Failure to make timely payment may result in cancellation of your reservation without refund.
Bookings made within 60 days of the tour start date must be paid in full at the time of booking.
2. Cancellation and Refund Policy
All cancellations must be submitted in writing to JMA via email or WhatsApp.
If cancellation is received more than 60 days prior to the tour departure, 50% of the deposit will be refunded.
If cancellation occurs within 60 days of the departure date, 25% of the deposit will be refunded.
Cancellations made within 14 days of the tour start date are non-refundable. No refunds will be given for unused services once the tour has commenced.
JMA strongly recommends that all clients purchase comprehensive travel insurance that includes trip cancellation, medical coverage, emergency evacuation, and personal liability.
3. Tour Cancellation by JC Motorcycle Adventures
JMA reserves the right to cancel any tour due to insufficient bookings, unforeseen circumstances, or events beyond our control, including but not limited to natural disasters, political unrest, or public health concerns.
In such cases, all payments made will be refunded in full, but JMA is not liable for any incidental costs incurred by the participant, such as flights, visas, vaccinations, or insurance.
4. Assumption of Risk and Release of Liability
Participation in a motorcycle tour inherently involves risk, including but not limited to injury, illness, property damage, or even death. Roads may be remote, unpaved, or poorly maintained, and riding conditions may vary due to weather or local traffic.
By joining a JMA tour, you voluntarily assume all such risks. You acknowledge that JC Motorcycle Adventures is not responsible or liable for any accidents, injuries, losses, or damages that may occur during the tour, whether caused by environmental factors, road conditions, mechanical failure, actions of third parties, or personal negligence.
All participants will be required to sign a Waiver and Release of Liability prior to the start of the tour. Refusal to sign this document will result in exclusion from the tour without refund.
5. Travel Insurance (Mandatory)
All participants are required to carry valid travel insurance with coverage for motorcycle riding (minimum 250cc), personal medical care, hospitalization, repatriation, evacuation, and third-party liability.
Proof of insurance must be presented before the tour begins. JMA reserves the right to refuse participation without refund if proper documentation is not provided.
6. Rider Responsibility
All riders must possess a valid motorcycle license and a minimum of two years of riding experience with motorcycles of similar or greater size than those provided.
Riders are expected to operate their vehicles in a safe and responsible manner and comply with all local traffic laws. Riding under the influence of alcohol or drugs is strictly prohibited and will result in immediate removal from the tour.
Participants are financially responsible for any damage to JMA motorcycles or property caused by negligence or improper use.
7. Itinerary Flexibility
Our tours are designed with adventure in mind. The itineraries are subject to change due to weather, road conditions, political situations, or other unforeseeable events. JMA will make every effort to provide an equivalent or improved experience in such cases.
No refunds/compensation will be provided for changes in itinerary beyond our control.
8. Use of Images and Likeness
By participating in a JMA tour, you grant permission for JC Motorcycle Adventures to use photographs or video of you taken during the tour for promotional and marketing purposes. If you do not wish to be photographed, you must inform us in writing before the tour begins.
9. Governing Law
These Terms and Conditions are governed by the laws of Ecuador, and any disputes will be subject to the exclusive jurisdiction of the courts located in Quito.
Acceptance of Terms
By submitting your booking and deposit, you affirm that you understand and agree to abide by these Terms and Conditions, and that you acknowledge the inherent risks of participating in a motorcycle adventure tour.
